Welcome to JA Property Care (JPC). By accessing or using our platform, dashboards, and associated services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform.
1. Software Service Only (Liability Truncation)
JA Property Care provides a cloud-based Property Management System (PMS) designed to facilitate portfolio organization, financial tracking, and maintenance routing. You explicitly acknowledge that:
- JPC acts strictly as a software service provider and is not a licensed real estate brokerage or property management agency under the Real Estate (Dealers and Developers) Act of Jamaica.
- JPC is not a party to any lease agreements, monetary disputes, or tenancy contracts executed via the platform.
- Compliance with the Rent Restriction Act of Jamaica, local housing regulations, and the lawful execution of tenant notices or evictions remains 100% the responsibility of the account holder.
2. Account Management & Hierarchy Liability
To use the platform, users must maintain accurate, complete account credentials. Account roles carry strict operational responsibilities:
- The primary agency account holder (Superadmin/Landlord) assumes absolute civil and structural liability for any data entry, modifications, and communications made by sub-accounts they provision, including Agents, Assistants, and Contractors.
- You are responsible for safeguarding your portal passwords and access credentials. JPC bears no liability for unauthorized access resulting from compromised local authentication.
3. Subscription, Billing, & Data Recovery
Access to professional administrative frameworks requires a recurring subscription:
- Subscription fees are billed in advance on a recurring monthly or annual basis. Failure to clear fees will result in automated, temporary suspension of administrative and multi-tenant portal routing.
- In the event of active subscription termination or account closure, agencies are granted a strict 30-day grace period to securely export their tenancy ledgers, property logs, and user data. Following this 30-day window, all associated data is permanently and cryptographically purged from active servers.
4. Acceptable Use Policy
You agree not to use the platform to process or host defamatory, illegal, or deceptive content. Any attempt to bypass multi-tenant isolation protocols, run malicious exploits against database structures, or manipulate financial transactional routing will result in instant account termination without a refund and formal notification to local regulatory authorities.
5. Governing Law
These Terms of Service shall be governed by, interpreted, and construed in complete alignment with the laws of Jamaica, without regard to conflict of law principles. Any legal actions or claims arising out of this platform must be brought exclusively within the courts of Jamaica.
