The "Grey Area": Wear and Tear vs. Damage
The most common dispute happens when a tenant moves out. A landlord wants to withhold the security deposit to repaint a faded wall, but the tenant argues it is just "normal wear and tear."
Under Jamaican law, a landlord cannot charge a tenant for normal wear and tear. You can only charge for actual, negligent damage. If you do not have proof of what the apartment looked like on move-in day, the Rent Assessment Board will likely rule in favor of the tenant.
